These Terms and Conditions (“Terms”) govern access to and use of the website and services offered by BRIGHT SHOPPING BAZAAR (“Company,” “we,” “us,” or “our”). By accessing the platform or placing an order, users agree to be legally bound by these Terms.

Section 1: E-Commerce Platform Terms (Direct Sales)

1.1 Acceptance of Orders

All orders placed through the platform are subject to acceptance by the Company. The Company reserves the right to refuse or cancel any order at its sole discretion, including after confirmation, in cases of pricing errors, stock unavailability, suspected fraud, or incorrect product information.

1.2 Product Information & Pricing Accuracy

While we make every effort to ensure accurate product descriptions, specifications, images, and pricing, inadvertent errors may occur.
The Company does not warrant that product descriptions, images, or prices are completely error-free.
In the event of an error (including typographical, pricing, or system errors), the Company reserves the unilateral right to cancel or modify the affected order.
If payment has been received for such an order, the amount will be refunded to the original mode of payment.

1.3 Limitation of Liability

To the maximum extent permitted by law:
BRIGHT SHOPPING BAZAAR shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to any purchase or use of the platform.
The Company’s total aggregate liability for any claim shall not exceed the net amount actually received by the Company for the specific product giving rise to the claim, excluding taxes, delivery charges, and other ancillary costs.

1.4 Shipping, Delivery & Risk

Delivery timelines provided on the platform are estimates only and are not guaranteed.
The Company shall not be responsible for delays caused by third-party logistics providers or events beyond reasonable control (“Force Majeure”), including but not limited to natural disasters, strikes, supply chain disruptions, or governmental actions.
Title and risk of loss shall pass to the customer upon delivery of the product to the designated carrier.

1.5 Returns & Refunds

Returns and refunds are governed strictly by the Company’s Refund & Return Policy.
The Company retains sole and final authority in determining eligibility for return or refund.
Returns may be refused if products are found to be used, altered, damaged, tampered with, or returned without original packaging and accessories.
Abuse of return privileges, including repeated cancellations or “wardrobing” (purchase for temporary use and return), may result in suspension or termination of the customer account.

1.6 User Conduct & Platform Integrity

Users agree not to:

• Engage in fraudulent transactions or payment disputes without valid cause.
• Misuse promotional offers or system vulnerabilities.
• Conduct activities that harm the reputation or operational integrity of the platform.

The Company reserves the right to suspend or permanently terminate accounts involved in suspicious or abusive activity and to report such actions to relevant authorities where necessary.

Section 2: Affiliate Marketing Program Terms

These terms govern participation in the Company’s Affiliate Marketing Program.

2.1 Independent Contractor Status

Participation in the affiliate program does not create any partnership, joint venture, agency, franchise, or employment relationship. Affiliates act as independent contractors and are solely responsible for their taxes, statutory filings, and regulatory compliance.

2.2 Commission Structure & Eligibility

Qualified Purchases
Commissions are payable only on “Qualified Purchases,” defined as:

• Orders that are fully paid,
• Successfully delivered, and
• Not cancelled or returned within the applicable “Anytime” cancellation/return window.

Modification of Commission
The Company reserves the absolute right to modify, reduce, suspend, or terminate commission rates or program structures at any time without prior notice.
Continued participation after such modification constitutes acceptance of the revised terms.

Payout Conditions
Payouts are subject to a minimum earning threshold.
Applicable Tax Deducted at Source (TDS) shall be deducted in accordance with Indian Income Tax laws.
Payments may be withheld in cases of suspected policy violation.

2.3 Prohibited Marketing Practices

Affiliates shall not:

• Engage in spamming, misleading claims, or deceptive advertising.
• Bid on Company-owned or branded keywords (including “Bright Shopping Bazaar”) in search engine marketing campaigns.
• Misrepresent product specifications, pricing, or policies.

Violation will result in immediate termination and forfeiture of accrued or pending commissions.

2.4 Intellectual Property License

The Company grants Affiliates a limited, revocable, non-exclusive, non-transferable license to use approved logos, banners, and promotional materials solely for authorized promotional purposes.
Affiliates may not modify, alter, or misuse Company intellectual property without prior written consent.

2.5 Cooling-Off & Clawback Provision

Given the Company’s flexible “Anytime” cancellation and return policy:

• Commissions will remain in a “Pending” status for a cooling-off period (minimum 30–60 days or as determined by the Company).
• If a customer cancels or returns a product, no commission shall be payable.
• If commission has already been disbursed for a returned or cancelled order, the Company reserves the right to deduct the amount from future payouts or require reimbursement.

2.6 Termination

The Company may:

• Terminate an Affiliate immediately and without notice in case of breach, or
• Terminate participation without cause by providing reasonable notice.

Upon termination, all rights to future commissions cease immediately.

2.7 Indemnification

Affiliates agree to indemnify and hold BRIGHT SHOPPING BAZAAR harmless against any claims, liabilities, losses, damages, penalties, or legal expenses arising from:

• Breach of these Terms,
• Unauthorized marketing practices, or
• Misrepresentation of products or policies.

Section 3: General Legal Provisions

3.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

3.2 Jurisdiction

Any disputes, claims, or legal proceedings arising out of or in connection with the platform or affiliate program shall be subject to the exclusive jurisdiction of the competent courts in Bangalore, Karnataka.

3.3 Amendments

The Company reserves the right to update, revise, or modify these Terms at any time without prior notice. Continued use of the platform following such changes constitutes acceptance of the updated Terms. Users are responsible for reviewing this page periodically.

3.4 Data Privacy & Compliance

Use of the platform is also governed by the Company’s Privacy Policy and applicable Indian laws, including:

• The Information Technology Act, 2000 and related Rules, and
• The Digital Personal Data Protection (DPDP) Act, as amended from time to time.

BRIGHT SHOPPING BAZAAR remains committed to transparent operations, platform integrity, and sustainable business practices while protecting its commercial interests and ensuring fair use for all users and affiliates.
